Terms and Conditions

No one can eliminate grief after a death loss, but a HealGrief coach may help alleviate some of the weight of suffering from planned support sessions. If you’re finding it challenging moving forward from your grief, a HealGrief coach may provide focus, clarity, and direction.

The purpose of a HealGrief Coach is to expand one’s perspective on grief and loss to benefit healthy post bereavement growth.

Potential Benefits

A HealGrief Coach seeks to help guide you into a deeper understanding of what it means to grieve. A HealGrief coach’s main objective is to help you plan and transition into your new life in a purposeful and meaningful way. Working with a HealGrief coach may help you answer the question of where you go from here when trying to pick up the pieces after a death loss. You can trust that the HealGrief coach will understand the impact a death loss has on every part of your life.

It is important to note that a HealGrief coach does not focus on grief-related emotions and conditions. Instead, they focus on getting you back on your feet after a significant setback so you can achieve a healthy post bereavement growth.

It is important to note that a HealGrief coach does not focus on your past or provide you with the necessary tools to explore unresolved feelings towards your relationship with your person. Instead, they support you moving forward and focus more on what comes next after suffering a death loss.

It is important to note that a HealGrief coach may not be a licensed mental health professional. Instead, they are compassionate individuals trained with a deep understanding of grief.

Medical Advice

A qualified healthcare provider can only provide specific medical advice. HealGrief is NOT a healthcare provider. If you have specific questions concerning your health or medical status, please consult your health care provider.

Additionally, emergency support is not available. If you are experiencing an emergency or life-threatening situation, feeling suicidal or homicidal, or are aware of child abuse, elder abuse, or dependent adult abuse, immediately call 911 or go to the nearest emergency room.

Potential Risks

Participating in one-on-one conversations with a HealGrief coach has its associated risks, including, but not limited to, experiencing uncomfortable feelings, such as sadness, guilt, anger, frustration, loneliness, and helplessness. These conversations often require discussing unpleasant aspects of one’s life, which may be disruptive as one seeks to move forward after a death loss. Therefore, it is essential to assess all the risks before proceeding with a HealGrief coach.

Terms of Use

Available to Actively Moving Forward (AMF) App members, members may select a time to meet with a HealGrief coach. All meetings are held through the App either via a hand-held device or web app. Members must ensure a strong wi-fi connection. Since sessions are held through the App, a member and their chosen coach must be connected within the App first for a meeting to occur. Failure to do so may forfeit your session and donation paid.

Rules of Engagement

Members agree to report and HealGrief coach behavior that may be deemed inappropriate immediately to HealGrief at Admin@HealGrief.org. Members also agree that inappropriate behavior includes, but is not limited to:

• Engaging in dual relationships such as forming friendships, romantic relationships, or bartering/paying for goods or services other than for the HealGrief Coaching services.
• Initiating, entertaining, or pursuing any form of sexual relationship including trading of inappropriate sexual content via video, email, text.
• Accepting of any form of gifts from a HealGrief coach.

Donations

Payment and Billing Services

HealGrief uses the Stripe API provided by Stripe, Inc. to process donations for services provided through the HealGrief website or third-party platforms. Donation processing is subject to the Stripe Connected Account Agreement (https://stripe.com/us/connect-account/legal) [and any other applicable Stripe agreement provided on the Stripe.com website]. By agreeing to these terms or continuing to utilize HealGrief coaches, you agree to be bound by the above referenced agreements and agree that such agreements may be modified by Stripe from time to time. As a condition of HealGrief enabling donation process services through Stripe, you agree to provide HealGrief accurate and complete information about you and your donation information and you authorize HealGrief to share it and transaction information related to your use of the donation processing services provided by Stripe.

You understand and agree that HealGrief will not be liable for any adverse event that arises from the processing of your donation through Stripe.

Indemnification

When using a HealGrief coach, you agree to indemnify and hold harmless HealGrief and its shareholders, officers, directors, employees, representatives, agents, coaches, and successors from and against any and all loss, damage, expense, liability, claims, or demands brought by any party whatsoever, arising out of or related to any behavior deemed inappropriate, any failure of technology or equipment, or failure to perform, whether or not any such loss, damage, expense, liability, claim, or demand arises from or relates to HealGrief’s negligence.

Limitation of Liability

HEALGRIEF IS NOT A PROFESSIONAL PRACTICE. ALL SERVICES WILL BE PERFORMED BY HEALGRIEF COACHES, AND HEALGRIEF WILL HAVE NO LIABILITY. THEREFORE, THE SERVICES PROVIDED BY HEALGRIEF ARE NOT INTENDED TO TREAT ANY ILLNESS, DISEASE, OR ADVERSE HEALTH CONDITION.

Furthermore, to the extent legally permitted under applicable law, HealGrief and its shareholders, officers, directors, employees, representatives, agents, coaches, and successors shall not be liable for any damages or injury, whether bodily or emotional, resulting from your access to, or inability to access a HealGrief coach, including but not limited to any and all advice, advise, recommendations, referrals and/or any such of this kind, either by HealGrief, or its coaches, or from any damages or injury, whether bodily or emotional, resulting from, but not limited to communication, interaction and/or engagement of any kind whether derived from within or outside of the virtual App community, and in no event shall HealGrief and its shareholders, officers, directors, employees, representatives, agents, coaches, and successors be liable for any direct, indirect, incidental, special or consequential damages, or damages for loss of profits, revenue, data or use, incurred by you whether in an action in contract or tort, that may arising.

HARDWARE AND SOFTWARE ARE COMPLEX AND MAY NOT BE COMPLETELY FREE OF ERRORS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEALGRIEF WILL NOT BE LIABLE FOR ANY DAMAGES ARISING UNDER THIS AGREEMENT. YOU SHOULD CONTACT HEALGRIEF IF YOU HAVE ANY CONCERNS OR CLAIMS RELATING TO HEALGRIEF OR ANY THIRD-PARTY PLATFORM USED BY HEALGRIEF.

Release

You hereby release HealGrief and its shareholders, officers, directors, employees, representatives, agents, coaches, and successors from any and all claims, demands any and all losses, damages, rights, claims, and actions of any kind, including, without limitation, personal injuries, death, and property damage, that is either directly or indirectly related to any engagement with HealGrief or its coaches.

MISCELLANEOUS PROVISIONS

Socio Terms of Use. The App operates on the Socio platform. In addition to these Terms and Conditions, App Members are subject to all privacy policies and terms of service issued by Socio.

Consequence of Breach. Any use of this App in violation of these Terms may result in, among other things, termination, or suspension of your rights to use this App and the licenses granted hereunder.

Governing Law and Forum. All matters relating to your access to, and use of, this App and these Terms shall be governed by U.S. federal law or the laws of the State of California. Any legal action or proceeding relating to your access to, or use of, this App shall be instituted in a state court located in Los Angeles County, California, and a federal court located in California and no other venue.

Severability. If any term or condition of these Terms is not fully enforceable or valid for any reason, such term(s) or condition(s) shall be severable from the remaining terms and conditions. The remaining terms and conditions shall not be affected by such unenforceability or invalidity and shall remain enforceable and applicable.

Entire Agreement. These Terms constitute the entire agreement between you and HealGrief regarding the use of this App and its contents. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
